Michael E. Hindin

A partner with the firm and co-chair of its Employee Benefits and Executive Compensation Group, Malcolm Hindin focuses his practice on employee benefits and tax issues affecting tax-exempt organizations.
He is also chair of the firm’s Pension Investment Committee and the partner responsible for the design of the firm’s retirement plans.
In the employee benefits area, Mr. Hindin advises clients as to the design and administration of qualified and non-qualified retirement plans, 403(b) tax-deferred annuities, 457 deferred compensation plans, welfare benefit plans, and ERISA fiduciary issues.
His tax-exempt organization work involves advising clients in obtaining and maintaining their tax exemptions and as to matters that include unrelated business income, employment and other taxes that apply to nonprofit organizations, controversies with the IRS, and governance issues.
Mr. Hindin’s work has included: Advising the trustee and plan administrator of a large defined contribution plan of a company in Chapter 11 on the wind-down of the plan, in a situation involving illiquid investments and holdings in company stock, Reviewing ERISA issues in, and reviewing documentation of, investments made by a large defined benefit plan in alternative investments, including venture capital, real estate, distressed debt, and other special situations, and Representing a university in a multi-million dollar employment-tax assessment relating to taxation of research and teaching assistants.
He is a member of the Employee Benefits Committee and the Exempt Organizations Committee of the American Bar Association’s Section of Taxation, the College and University Law Group of the Boston Bar Association, and the National Association of College and University Attorneys.
